Opposing a Religious Exemption to Sex Discrimination Protections in the ACA
Section 1557 of the Affordable Care Act prohibits discrimination in health programs and activities on the basis of race, color, national origin, sex, age, or disability—including important non-discrimination protections for women and LGBT people. In September 2015, the Department of Health and Human Services drafted proposed regulations to implement this non-discrimination provision and asked for public comment on whether the prohibition on sex discrimination should include a religious exemption. We submitted comments and said absolutely not. On May 18, 2016, the Department issued a final rule that did not contain a new religious exemption.
