On Friday, the Department of Education and Department of Justice issued guidance to public schools nationwide reminding schools Title IX prohibits discrimination against transgender students, including denying them access to the restrooms and other facilities consistent with their gender identity. In addition, the Departments provided schools with best practices from schools across the country. The Departments’ goal is to help schools create a safe, welcoming, and supportive learning environment for every student. The guidance comes amidst the backlash to North Carolina’s HB 2. At the same time, in Illinois and North Carolina, religious freedom laws are being misused to try to take away the rights of transgender students. Stay tuned.
